Background-Screening Disclosure & Authorization
Last updated: draft, not yet published.
Standalone disclosure
ThirdSpot may obtain a consumer report and/or investigative consumer report about you from a consumer reporting agency for the purpose of evaluating your eligibility for ThirdSpot membership. This disclosure is provided to you in a document that consists solely of this disclosure, as required by the Fair Credit Reporting Act (FCRA) and California's Investigative Consumer Reporting Agencies Act (ICRAA) / Consumer Credit Reporting Agencies Act (CCRAA).
What is screened
The screening evaluates public records for categories including violent felonies, sexual offenses, crimes against children, human trafficking, stalking, recent domestic violence, and felony substance-related offenses. ThirdSpot does not make a final denial decision based solely on automated processing — see "How a result is handled" below.
Your authorization
By checking the authorization box during registration, you authorize ThirdSpot and its background-screening provider to obtain the consumer report(s) described above. You may withdraw this authorization at any time by closing your account, which also withdraws your membership eligibility.
How a result is handled
- Clear result — automated approval.
- Potentially relevant result — your application moves to a restricted-pending status while a ThirdSpot administrator reviews it.
- Possible denial — a legally-reviewed pre-adverse-action process begins; see Pre-Adverse & Final Adverse Action for your rights and the timeline.
Your rights under FCRA/California law
- You have the right to request a copy of your consumer report.
- You have the right to dispute inaccurate or incomplete information directly with the consumer reporting agency.
- If ThirdSpot takes adverse action based in whole or in part on your report, you will receive notice, a copy of the report, and a summary of your rights before any final decision, with time to respond — see Pre-Adverse & Final Adverse Action.
Annual rescreening & continuous monitoring
Active membership requires rescreening at least once every 12 months. Where a screening provider contractually and legally supports it, ThirdSpot may also enroll active members in continuous criminal monitoring; a material alert temporarily restricts the account pending human review rather than triggering an automatic suspension.
Fees
The background-screening fee is separate from your membership subscription and activation fee, is paid directly by you, and is never covered by attendance refunds or membership credits.
