Pre-Adverse & Final Adverse Action

If your background report shows a possible issue
If information in your consumer report may result in ThirdSpot declining or restricting your membership, you will receive a pre-adverse action notice before any final decision is made. That notice includes:
- A copy of the consumer report ThirdSpot relied on.
- A summary of your rights under the Fair Credit Reporting Act and applicable California law.
- A waiting period (draft default: 5 business days — subject to counsel confirmation) before any final decision, so you have time to review the report and respond.
How to dispute
If you believe the report is inaccurate or incomplete, you may dispute it directly with the consumer reporting agency that produced it. ThirdSpot will consider any dispute resolution or additional information you provide before finalizing a decision. Use the dispute contact information included in your pre-adverse action notice.
Final adverse action
If, after the waiting period, ThirdSpot proceeds with declining or restricting your membership based in whole or in part on the report, you will receive a final adverse action notice stating:
- The decision made.
- The name, address, and phone number of the consumer reporting agency that furnished the report.
- A statement that the reporting agency did not make the decision and cannot explain the specific reason for it.
- Your right to obtain a free copy of your report from that agency within 60 days.
- Your right to dispute the accuracy or completeness of the report with that agency.
This is never a fully automated decision
No final denial is made solely by automated processing. A ThirdSpot
administrator reviews every possible-denial case before a
pre-adverse notice is sent, and again before any final adverse
action, with the full evidence trail available for review — see
IMPLEMENTATION-TODO.md for the current status of this
workflow.
