Terms of Service & Agreements
Last updated: draft, not yet published.
1. Terms of Service
These Terms govern use of the ThirdSpot platform (the "Service"), operated for members 21 years of age and older in the Greater Sacramento region and, over time, additional cities and regions. ThirdSpot provides identity verification, background screening, event discovery, registration, QR-based check-in, and related platform tools connecting verified members with recurring activities hosted by verified local businesses.
ThirdSpot is not a dating service, an anonymous social network, a direct-messaging platform, or an event organizer responsible for operating any venue. ThirdSpot does not organize, staff, supervise, or control the physical conduct of any activity — that responsibility belongs to the hosting business, subject to the Business Host Agreement below.
2. Membership Agreement
By registering as a member, you represent that you are at least 21 years of age, that the identity information you provide is accurate, and that you consent to identity verification and background screening as described in the Background-Screening Disclosure. Membership requires payment of a recurring monthly subscription and a one-time activation fee, both described at Membership, and remains subject to continued eligibility (including annual rescreening).
ThirdSpot may restrict or suspend a membership for policy violations, safety concerns, background-screening results, or repeated no-shows/late cancellations, following the process described in the Community Standards below. Permanent account termination is never automated — a human administrator makes that decision.
3. Community Standards
Members agree not to:
- Use ThirdSpot for dating, matchmaking, or romantic-partner solicitation of any kind.
- Harass, stalk, intimidate, discriminate against, or threaten any member or business.
- Provide false identity information or attempt to circumvent identity or background verification.
- Misuse emergency-contact information accessed on event day.
- Engage in illegal activity in connection with any ThirdSpot event.
Reports of safety concerns, harassment, or misconduct are reviewed by ThirdSpot administrators; see Report a concern. Blocking another member is available at any time and does not notify the blocked member.
4. Event Host Standards
Verified businesses may publish recurring events consistent with their verified business type, licenses, insurance coverage, and physical location, subject to the certifications described in the Business Host Agreement below. Dating-oriented events, discrimination, explicit sexual content, promotion of illegal substances, and activities inconsistent with a business's verified insurance are prohibited outright; weapons-related events from appropriately licensed businesses always receive enhanced human review before publication.
5. Business Host Agreement
ThirdSpot provides the platform, member verification, registration, and attendance tools. The hosting business controls its premises, staff, activity operations, safety procedures, licensing, and venue hazards, and is solely responsible for the safe operation of any event it publishes. By publishing an event, a business's authorized representative certifies — among other items detailed in the event-builder certification step — that the event occurs at an active, verified, insured business location; is consistent with the business's normal operations; complies with applicable law; and is not a dating, discriminatory, or otherwise prohibited activity. False certification may result in event removal, publishing restriction, or account suspension.
Members remain responsible for selecting activities appropriate to their own health, ability, experience, and risk tolerance — see the Activity Waiver and Release.
6. Refund & Cancellation Policy
Membership subscriptions may be cancelled at any time; the
activation fee and background-screening fee are, by default, not
refunded on application rejection (subject to change — see
IMPLEMENTATION-TODO.md for the current
business-decision status of this default). Event-level cancellation
penalties and monthly attendance refunds are described in the
Membership page and applied
automatically per the schedule configured in the platform.
7. General
These Terms are governed by the laws of the State of California. ThirdSpot may update these Terms from time to time; material changes will be versioned and re-presented for acceptance where required by law. See also the Privacy Policy, Activity Waiver and Release, and Background-Screening Disclosure.
