Activity Waiver and Release
Last updated: draft, not yet published.
Different activities carry different risks
ThirdSpot connects members with a wide range of recurring activities hosted by independently-operated, verified local businesses — from low-risk activities like coffee meetups and book clubs to higher-energy activities like fitness classes or outdoor sports. You are responsible for choosing activities appropriate to your own health, physical ability, experience level, and personal risk tolerance. ThirdSpot does not evaluate your individual fitness for any specific activity.
Assumption of risk
By registering for any ThirdSpot event, you acknowledge that participation in in-person group activities carries inherent risks, including but not limited to physical injury, and you voluntarily assume those risks. You agree to follow the safety instructions provided by the hosting business and to leave any activity you no longer feel able to safely participate in.
Responsibility allocation
ThirdSpot provides the platform, member verification, registration, and attendance tools. The hosting business controls its premises, staff, activity operations, safety procedures, licensing, and venue hazards — see the Business Host Agreement in Terms of Service. You remain responsible for your own conduct and choices during any activity.
Release
To the fullest extent permitted by law, you release ThirdSpot from liability for injury, loss, or damage arising from your voluntary participation in any activity discovered through the platform, except to the extent caused by ThirdSpot's own gross negligence or willful misconduct. This release does not apply to the hosting business's own liability for the conditions of its premises or the conduct of its staff, which is addressed separately in the Business Host Agreement.
Photo, video & social-media release
During onboarding you are asked to select your preference regarding photo/video capture at events and its use in ThirdSpot or hosting-business marketing. Your selection is recorded and versioned as a consent record and can be changed at any time in your account settings once that control exists.
Acknowledgment
Accepting this waiver during registration is required to become an active member. A record of your acceptance, including the version of this document accepted and the timestamp, is retained per Privacy Policy.
